Elmyra – Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your access to and use of Elmyra (the "Service"), including our website, applications, and any related services (collectively, the "Platform").

By accessing or using Elmyra, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

Elmyra is an AI-powered conversational platform that generates fictional, virtual characters for entertainment and companionship purposes only.

2. Eligibility and Age Requirement

You must be at least 18 years old to use Elmyra.

By using the Service, you represent and warrant that:

  • You are 18 years of age or older.
  • You have the legal capacity to enter into these Terms.

We do not knowingly allow minors to use the Service. Any account found to violate this requirement may be terminated immediately.

3. Account Registration

Some features of the Service require you to create an account.

You agree to:

  • Provide accurate and complete information.
  • Keep your account credentials confidential.
  • Be responsible for all activity under your account.

We are not responsible for unauthorized access resulting from your failure to safeguard your login credentials.

4. Nature of the Service

Elmyra provides conversations with artificial intelligence–generated, fictional characters.

You acknowledge and agree that:

  • All characters and interactions are entirely fictional.
  • Conversations are generated by AI and do not represent real people.
  • The Service is provided for entertainment purposes only.
  • The Service does not provide professional, medical, legal, or psychological advice.

5. Acceptable Use

You agree not to use the Service for any unlawful, harmful, or abusive purpose, including but not limited to:

  • Violating any applicable laws or regulations.
  • Exploiting, abusing, or endangering others.
  • Attempting to reverse engineer, copy, or extract our models, algorithms, or systems.
  • Using the Service to train or develop competing AI systems.
  • Misrepresenting AI-generated content as human-generated.
  • Engaging in or promoting violence, trafficking, exploitation, or abuse of any kind.

We reserve the right to suspend or terminate accounts that violate these rules.

6. Content and AI Output

User Input

You are responsible for the content you submit ("Input") and represent that you have the right to provide it.

AI Output

AI-generated responses ("Output") may be inaccurate, incomplete, or inappropriate.

  • Output should not be relied upon as factual or professional advice.
  • Similar or identical Output may be generated for other users.

7. Intellectual Property

All rights, title, and interest in the Service, including software, design, characters, branding, and AI systems, belong exclusively to Elmyra or its licensors.

You may not copy, distribute, modify, or exploit any part of the Service without prior written consent.

8. Subscriptions and Payments

Some features of Elmyra require a paid subscription.

By purchasing a subscription:

  • You authorize recurring billing until cancellation.
  • Prices are disclosed prior to purchase.
  • Subscriptions renew automatically unless canceled.

You may cancel your subscription at any time through your account settings. Payments are non-refundable, except where required by law.

We may change pricing with reasonable advance notice.

9. Termination

You may stop using the Service at any time.

We may suspend or terminate your access if:

  • You violate these Terms.
  • Your use poses risk or harm.
  • Required by law.

We may also discontinue the Service entirely, with reasonable notice when possible.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND.

We do not guarantee that the Service will be uninterrupted, error-free, or secure.

11. Limitation of Liability

To the maximum extent permitted by law:

  • Elmyra shall not be liable for any indirect, incidental, consequential, or special damages.
  • Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim, or USD $100, whichever is greater.

12. Indemnification

You agree to indemnify and hold harmless Elmyra from any claims arising out of:

  • Your use of the Service
  • Your violation of these Terms
  • Your content or conduct

13. Changes to These Terms

We may update these Terms from time to time.

If changes materially affect your rights, we will provide reasonable notice. Continued use of the Service constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of Uruguay, without regard to conflict of law principles.
